These Terms of Service ("Terms") govern your access to and use of the M-KUWA website and services provided by M-KUWA Ltd, a company registered in England and Wales ("M-KUWA", "we", "us", or "our"). M-KUWA provides a trust score infrastructure for Kenya, including consumer-facing Trust Scores and partner decision-support tools. Our services include:

• Generation and delivery of Trust Scores based on consented data inputs.
• Consumer access to view, understand, and improve their Trust Scores.
• Partner dashboards and APIs for receiving Trust Score outputs.
• Supporting verification indicators and decision-support information.

M-KUWA provides scoring and decision support — not lending or credit decisions. We provide a signal, not the decision itself.

3. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User obligations

When using our services, you agree to:

• Provide accurate, current, and complete information when requested.
• Not use the services for any unlawful purpose or in violation of any applicable law or regulation.
• Not attempt to gain unauthorised access to any part of our systems or services.
• Not interfere with or disrupt the integrity or performance of our services.
• Not reproduce, duplicate, copy, sell, or exploit any portion of the services without our express written permission.

5. Consent and data sharing

6. Partner obligations

Partners who access M-KUWA Trust Scores and related outputs agree to:

• Use Trust Score data only for the consented purpose and within the agreed time period.
• Not use Trust Scores to discriminate on the basis of protected characteristics.
• Maintain appropriate technical and organisational security measures to protect Trust Score data.
• Comply with all applicable data protection laws, including the UK GDPR and Kenya's Data Protection Act 2019.
• Not re-sell, redistribute, or share Trust Score data with third parties without M-KUWA's prior written consent.

7. Intellectual property

All content, trademarks, logos, and intellectual property displayed on the M-KUWA website and services are the property of M-KUWA Ltd or its licensors. You may not use, reproduce, or distribute any content from our services without prior written permission.

8. Disclaimers

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

• We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of Trust Scores.
• Trust Scores are decision-support tools and should not be the sole basis for any decision. Partners remain responsible for their own decisions.
• We do not guarantee uninterrupted or error-free operation of our services.

9. Limitation of liability

To the maximum extent permitted by applicable law, M-KUWA Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of our services. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.

10. Dispute resolution

We encourage you to contact us first to resolve any disputes informally. You can reach us at mkonde@mkuwa.com. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Termination
